Trucking Companies Allege Deceptive Practices

Three trucking companies have joined forces in a lawsuit against Memphis-based A-1’s Towing, accusing the company of creating deceptive parking areas to entrap unsuspecting commercial truck drivers.

Trucking Companies Seek Damages

On March 4, 2024, Western Express, Inc., MHT Group, Inc., and Church Transportation and Logistics initiated legal action against A-1’s Towing in the U.S. District Court for the Western District of Tennessee. The lawsuit aims to recover up to $5 million in damages alongside legal expenses.

Alleged Affiliates and Owner Implicated

The lawsuit targets A-1’s Towing owner Colton Ahmad Cathey and several purported "alter ego" entities, including A1’s Xclusive, LLC, A1’s Car Hauling, LLC, CAC Operations LLC, A1’s Aplex Memphis, Acord Security, S-Line LLC, and S-Line Truck Parking.

Violations of RICO Act

The lawsuit alleges violations of the Racketeer Influenced and Corrupt Organizations Act (RICO), citing A-1’s Towing's involvement in deceptive practices and unlawful actions affecting interstate commerce. These purported actions include interference with commerce, fraud, violations of Tennessee towing statutes, and breaches of the Tennessee Booting Consumer Protection Act.

Deceptive Parking Practices

According to the complaint, A-1’s Towing and its affiliates orchestrated a scheme involving the creation of deceptive parking areas near major truck stops and convenience markets. The goal was to attract commercial truck drivers and subsequently tow or boot their vehicles unlawfully, regardless of the legitimacy of their parking.

Examples of Harassment

The lawsuit outlines instances of alleged harassment and threatening behavior by A-1’s Towing employees. These incidents include attempts to prevent drivers from resting by honking horns and rocking vehicles, as well as intimidating drivers with firearms and bulletproof vests during tow disputes.

Denial of Wrongdoing

Despite the accusations, A-1’s Towing has consistently denied any wrongdoing. The company has retaliated by filing a lawsuit against the city of Memphis, Memphis Police Chief Cerelyn Davis, and Memphis police officers, alleging discrimination against A-1’s Towing as a minority-owned
